Thirty9 provides creative, digital, and strategic services, including (but not limited to) design, branding, content creation, video, AI-assisted production, marketing strategy, and website support.
While we apply professional care, experience, and industry best practice to all work, the following terms apply:
Creative & Strategic Work
All creative output is inherently subjective. By engaging Thirty9, you acknowledge that creative decisions, interpretations, and outcomes may vary based on brief clarity, available materials, timelines, and external factors.
Strategic recommendations are provided in good faith, based on available information at the time. We do not guarantee specific commercial results, performance metrics, revenue growth, rankings, engagement levels, or conversions unless explicitly agreed in writing.
AI-Assisted Services
Some services delivered by Thirty9 may utilise AI-assisted tools as part of the creative or production workflow.
AI is used to enhance efficiency, ideation, and execution — not to replace professional judgement, creative direction, or human oversight.
Due to the evolving nature of AI technologies, outputs may occasionally contain inconsistencies, limitations, or errors. Final responsibility for approval of all deliverables rests with the client.
Thirty9 is not liable for any third-party claims arising from AI-generated or AI-assisted content once approved and published by the client.
Accuracy & Compliance
We do not provide legal, financial, medical, or regulatory advice.
It is the client’s responsibility to ensure that all content, claims, advertising materials, and outputs comply with applicable laws, industry regulations, platform rules, and advertising standards (including but not limited to ASA, GDPR, and platform-specific policies).
Any factual claims, testimonials, reviews, or performance statements supplied by the client remain the client’s responsibility.
Third-Party Platforms & Tools
Thirty9 may recommend or work with third-party platforms, software, hosting providers, or tools.
We are not responsible for outages, changes, pricing updates, feature removals, algorithm changes, policy enforcement, or data loss caused by third-party services.
Ongoing access to third-party tools may be subject to separate terms and fees outside of Thirty9’s control.
Limitation of Liability
To the fullest extent permitted by law, Thirty9 shall not be liable for any indirect, consequential, or commercial losses, including but not limited to loss of profits, revenue, data, or business opportunities.
Our total liability for any claim arising from services provided shall not exceed the total fees paid for the relevant service, unless otherwise agreed in writing.
